Acceptable Use Policy

Important: Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

1. Your Responsibility

As a user of the RealToClose platform, you are solely responsible for ensuring that all SMS messages and voice calls made through your account comply with all applicable federal, state, and local laws and regulations. RealToClose provides the technology platform; you are responsible for how you use it.

2. TCPA Compliance

The Telephone Consumer Protection Act (TCPA) imposes strict requirements on automated communications. You must:

  • Obtain prior express consent before sending any SMS messages or placing AI voice calls to any individual
  • Maintain records of consent for each contact in your database
  • Honor all opt-out requests immediately and permanently
  • Not contact numbers on the National Do Not Call Registry unless you have prior express consent or an established business relationship
  • Identify yourself in all communications (the AI agents are configured to do this)

TCPA violations can result in fines of $500 to $1,500 per message or call. RealToClose is not responsible for TCPA fines or penalties resulting from your use of the platform.

3. Consent Requirements

Before uploading any contact to the platform or initiating any communication, you must ensure that:

  • The individual has given explicit consent to receive automated SMS messages and/or voice calls
  • The consent was freely given and not obtained through deceptive practices
  • You can demonstrate proof of consent if challenged
  • The consent has not been revoked

4. 10DLC Compliance

All SMS messaging through the platform must comply with 10DLC (10-Digit Long Code) regulations:

  • Your campaigns must be registered and approved through the 10DLC process
  • Message content must match the registered campaign use case
  • You must not exceed the throughput limits assigned to your campaign
  • All messages must include opt-out instructions

5. Prohibited Uses

You may NOT use the Service to:

  • Send unsolicited messages (spam) to individuals who have not consented
  • Contact individuals who have opted out or requested to stop receiving communications
  • Mislead or deceive recipients about the nature of the communication
  • Engage in harassment, threats, or abusive communications
  • Violate any law or regulation, including real estate licensing laws
  • Upload data obtained through illegal means (scraping, purchasing non-consented lists, etc.)
  • Impersonate another person or entity
  • Send messages containing discriminatory, hateful, or offensive content
  • Use the Service for any purpose other than legitimate real estate business
  • Attempt to circumvent opt-out protections or business hour restrictions
  • Share account access with unauthorized individuals

6. Opt-Out Handling

The platform includes built-in opt-out protection. When a recipient sends STOP, UNSUBSCRIBE, or similar keywords:

  • The system automatically stops all future communications to that number
  • A confirmation message is sent to the recipient
  • The opt-out is permanent unless the recipient re-subscribes

You must not attempt to circumvent, disable, or override the opt-out system.

7. Business Hours

The platform enforces business hours for all automated communications. Messages and calls are only sent during your configured business hours in your local timezone. You must not configure business hours in a way that would violate TCPA quiet hours (before 8:00 AM or after 9:00 PM in the recipient's local timezone).

8. Data Responsibility

You are responsible for:

  • The accuracy and legality of all data you upload to the platform
  • Ensuring you have the right to use and process the personal data of your contacts
  • Responding to data access, correction, or deletion requests from your contacts
  • Notifying affected individuals in the event of a data breach involving their information

9. Enforcement

We reserve the right to:

  • Monitor usage for compliance with this policy
  • Suspend or disable SMS/voice features if we detect potential violations
  • Terminate your account without refund for serious or repeated violations
  • Report violations to relevant authorities if required by law
  • Cooperate with investigations by carriers, regulatory bodies, or law enforcement

10. Reporting Violations

If you become aware of any misuse of the platform, or if you receive unwanted communications from a RealToClose user, please contact us through the Contact page.

11. Changes to This Policy

We may update this Acceptable Use Policy at any time. Material changes will be communicated through the platform and will require your acceptance to continue using the Service.
